An officer with the Waterloo Regional Police Service (WRPS) has been cleared by the Special Investigations Unit (SIU) of any wrongdoing in a case from March of this year, that saw a man’s leg fractured during his arrest. On March 21, officers were at the Canadian Convention Centre on Bramsteele Road in Brampton, looking to arrest multiple suspects wanted in connection with tractor trailer load thefts. The men tried to drive away, and reportedly hit several police cruisers in the process.

An officer then smashed the window of the car, and attempted to discharge a conducted energy weapon at the driver. That driver was eventually taken out of the vehicle and brought to the ground by officers where he was struck several times and handcuffed. The report from the SIU said the 46-year-old was kneed twice in the lower torso, and punched twice.

He was sent to hospital with a fractured femur. “The man was endangering the lives of the officers while trying to use his vehicle as a weapon and it was imperative he was immediately stopped,” said the report from SIU Director Joseph Martino. “The officers say the Complainant struggled against their efforts to handcuff him and the blows were necessary to overcome his resistance.”

Martino added based on the officers’ weeks of surveillance into the individuals’ involvement in an alleged crime ring, he is confident the actions taken were in the officers’ rights. “While I accept that the Complainant’s leg was fractured at some point in the dynamic sequence of events that culminated in his arrest, there are no reasonable grounds to believe the injury is attributable to unlawful conduct on the part of the arresting officers.” The full report from the SIU can be read here.
